Art. 212 of the Labor Code of the Russian Federation contains instructions that the employer’s administration in some cases is obliged to:

  • organize medical examinations, including at the request of the workers themselves;
  • do not allow employees to work who have not passed the mandatory medical commission, as well as if they have medical restrictions.

These provisions indicate that a referral form for a medical examination must be issued to a future employee before signing an employment agreement with him. This fact in itself does not prove that the employee has been hired for the specified position or that an agreement will be signed with him. If, based on the results of a medical examination, it is discovered that the candidate is not suitable for the desired position due to health reasons, he will be denied employment in accordance with Part 3 of Art. 84 Labor Code of the Russian Federation.

According to Art. 213 of the Labor Code of the Russian Federation establishes the following types of medical examination:

The purpose of a referral for a medical examination when applying for a job

The employer has every right to not allow an employee to work if he has not passed the mandatory medical examination. A mandatory preliminary medical examination (before employment) is also established for employees who, in the course of their activities, will be associated with:

  • hazardous production;
  • harmful working conditions;
  • traffic movement.

Who undergoes periodic medical examinations:

  • persons under 21 years of age;
  • employees to prevent the development of occupational diseases;

There are also categories of employees who must undergo periodic medical examinations before each time they go to work, for example, drivers.

An employee who must undergo a preliminary (regular) examination by a doctor (doctors) receives a referral for a medical examination. With this referral, the employee comes to a medical institution, with which the company has an agreement to provide certain services necessary to undergo a medical examination.

Schedule a repeat medical examination

A repeated medical examination upon hiring is appointed by the enterprise's human resources department for the following reasons:

  1. During the period of validity of the medical examination upon employment, the person suffered a serious illness or surgery. In this case, it becomes necessary to undergo a new examination and obtain a fresh conclusion. Changes in a person’s health status that occur after receiving the certificate may lead to his professional unsuitability in the chosen field. For this reason, past results become irrelevant.
  2. During the validity period of the certificate, the person changed his place of employment. For example, an employee underwent examination in the direction of the organization, but after receiving the certificate he changed his mind about working in the chosen place. A person can bring the remaining medical report with a valid expiration date to a new place, but, as a rule, human resources departments refuse to accept such a certificate. This is due to different working conditions, with different requirements for the list of examinations and examinations by specialists.

For objective reasons, the employer doubts the reliability of data on the health status of the future employee.

A repeat examination is scheduled to verify the results obtained. Often it includes examination by additional specialists, new tests, etc.

A person is being examined in a medical facility other than the one to which he was referred.

In most cases, human resources departments do not accept certificates obtained from third-party medical institutions.

How is a referral for a preliminary medical examination issued?

A referral for a medical examination on the employer’s letterhead is given to the specialist applying for a job in person against signature. If an employee does not pass or refuses to undergo a medical examination, the employer is obliged not to allow him to perform his job duties or to suspend him from work (paragraph 13, part 2, article 212 and part 1, article 76 of the Labor Code of the Russian Federation).

The medical examination is considered completed if the employee has passed all the doctors, and all planned laboratory diagnostic tests have been carried out. Based on the results of the examination, the person applying for work is given a conclusion.

The conclusion is drawn up in two copies. One is given to the enterprise, and the second copy of the report remains in the medical institution and is attached to the outpatient medical record, which is created immediately after presentation of the referral for a medical examination.

Time for re-examination

The timing of re-inspections is set by the employer and usually does not exceed one week.

The reluctance of a job applicant to re-receive a valid medical examination for work within the established time frame leads to a refusal to employ him.

Thus, a valid pre-employment medical examination is a prerequisite in cases established by law.

The result of passing a medical examination when applying for a job is to receive a certificate in a unified form that has an expiration date.

How to properly submit a referral?

The referral form for a preliminary or periodic medical examination does not have an approved form. However, there is a list of required details (clause 8 of Appendix No. 3 to the order of the Ministry of Health and Social Development dated April 12, 2011 No. 302n):

A referral for a medical examination is issued to a future employee by the employer. In this case, each issued direction is subject to registration.

You can register a document in the Outgoing Documentation Journal . But if the number of directions issued is large, a separate journal is started.

There is no unified form for such a journal, so it is filled out in free form. But the required columns must be included:

  • date of registration;
  • registration number;

For an additional fee, you can undergo a medical examination within one day.
To quickly obtain a certificate, you will need to spend half a day. You can use this option only if you are visiting a private clinic. If a citizen wants to pay less money for an examination, then he must visit a public clinic. In this case, it will not be possible to cope in one day. As already mentioned, monitoring the health of employees is carried out under the condition that the latter work in harmful and dangerous production; clinics and representatives of professions who in one way or another come into contact with a large number of people regularly visit clinics. Mandatory periodic medical examinations are required for employees:

  • Food industry, food trade, public catering - tests for infectious diseases and STDs are performed twice a year, as well as analysis for staphylococcus carriage and other bacteriological studies. Once a year, fluorography, consultation with a therapist and laboratory tests for the presence of helminths are prescribed.
  • Children's preschool, school and secondary vocational medical institutions - examinations for the presence of STDs, infectious diseases and bacteriological studies are carried out up to 4 times a year. A general therapeutic commission with fluorography and laboratory tests is required once a year.
  • Pharmacies and non-food trade - once a year, examination by a dermatovenerologist, therapist, fluorography and laboratory tests are indicated.
  • Communal services for the population and swimming pools - they are examined for the presence of STDs 2 times a year and undergo a standard medical examination 1 time a year. Vaccination against diphtheria is required.
