The list of prohibitions is given in Federal Law No. 15 of February 23, 2013. The regulation states that smoking tobacco is prohibited inside a catering establishment. The rules also apply to smoking hookah with tobacco. It is prohibited to create smoking and hookah rooms in public catering establishments. If the premises are owned by a cafe or restaurant, a ban is also imposed on it. There are no exceptions.

Smoking is not allowed on the terraces of cafes and restaurants. Through the court, you can try to prove to Rospotrebnadzor that the place is not a premises.

The question remains open; cases that go to court are usually considered individually. Violation may result in a fine. The amount of monetary penalty for the violator is 500-1500 rubles. If the incident occurred for the first time, the amount of the penalty will be minimal. In case of a repeated incident, the amount will increase to 1,500 rubles. The organization will also be punished. If the business belongs to an entrepreneur and the establishment is located in a residential building, the fine will be 30,000-40,000 rubles. When the premises are owned by a legal entity, the fine will increase to 60,000-90,000 rubles.
