Why use

They are used in the procurement of goods, works or services with restrictions for small and medium-sized businesses. We remind you that the obligation to place orders and enter into contracts with representatives of SMEs is enshrined in law (Article 30 44-FZ). The total share of contracts with small and medium-sized businesses for government customers is at least 15% of the SGOZ. Procurement among SMEs is carried out in two ways:

• if the NMCC is less than 20 million rubles, only mini-businesses and SONPOs are allowed to participate in the auction;
• if NMCC - 20 million rubles. and higher, then the restriction is not set exclusively for SMP, but the winner must attract co-executors from among SMP and SONKO.

A potential supplier is required to confirm that it belongs to SMEs. In Art. 3 of Federal Law No. 209-FZ on the development of small and medium-sized enterprises states that small and medium-sized enterprises are legal entities and individual entrepreneurs, which, according to the criteria of this law, are classified as small enterprises, including micro- and medium-sized enterprises, information about which entered into the unified register of small and medium-sized businesses.

How to obtain an extract from the SMP register

If you are purchasing among small and medium-sized enterprises, then participants must provide declarations of affiliation with such entities. A generated extract from the register of small and medium-sized businesses using TIN is an additional document that will help the customer identify an unscrupulous contractor.

Federal Tax Service specialists maintain a single list based on reporting information and information sent by representatives of mini-businesses (including micro-enterprises). For the convenience of organizers (tax officers) and customers, the register of SMEs by TIN from the tax website is automatically transferred to an additional branch of the resource https://www.nalog.ru/. For each enterprise the following information is indicated:

• TIN;
• OGRN;
• full and abbreviated name;
• date of registration of the legal entity;
• date of inclusion in the list;
• location;
• EMS category;
• types of economic activities;
• average number.

If a legal entity does not provide information about the average headcount, information about this company will not be included in the Federal Tax Service list.

You have received an application to participate in the auction from SMSP. Here's how to check an enterprise by TIN in the SMP register:

Step 1. We study the received applications for participation in government procurement.

Step 2. Go to the SME register on the tax website.

Step 3. Enter the necessary information - TIN, OGRN or name. If this participant is a mini-business, information about him will appear in the search results.

In the open part of the register of small and medium-sized businesses in 2020, only the name, type of enterprise, TIN, OGRN and region code are displayed. All other information is presented in the statement itself, which is downloaded in PDF format.

Unified Register of Small and Medium Enterprises

The database contains information about legal entities and individual entrepreneurs included in the Unified Register of Small and Medium-Sized Enterprises.

The data is presented in 3 types:

• The folder “By main OKVED code” presents SMEs, divided by main OKVED code (see also the table below “TOP 100 OKVED codes”);
• The folder “By region” presents SMEs, broken down by region of the Russian Federation (see also the table below “Number of SMEs by region of Russia”);

• Unified register of SME entities_add_OKVED.csv - additional OKVED codes for each SME entity
• Unified Register of SMEs - only individual entrepreneurs.csv - only individual entrepreneurs

When to provide a declaration instead of an extract

In Part 3 of Art. 30 44-FZ states that participants are required to declare that they belong to a mini-business in procurement with restrictions for small and medium-sized enterprises. The law on the contract system states that this declaration is generated automatically using software and hardware of the electronic platform during the application process. But an extract from the register of small and medium-sized businesses is also used as this declaration. If a potential supplier does not declare that he belongs to a mini-business, his application will be rejected under Part 6 of Art. 69 44-FZ.

Position of the Federal Tax Service

The press service of the Federal Tax Service, in response to a TASS request for comment on the initiative of the business ombudsman, stated that “the functions of developing state policy and legal regulation in the field of development of entrepreneurial activity, including medium and small businesses, are carried out by the Ministry of Economic Development of the Russian Federation "

“Thus, on issues related to legal regulation in the field of entrepreneurial activity, including medium and small businesses, you should contact the Ministry of Economic Development,” the Federal Tax Service clarified.
