Catering can operate as a manufacturer and distributor of various types of food products. Unfortunately, OKVED does not have a “Public Catering” item, but there is a separate section indicating the operation of hotels and restaurants. No licenses are required to organize catering operations, but reduced rates for insurance premiums and contributions related to injuries depend on the codes used by LLCs or individual entrepreneurs. The choice between two forms of doing business is not an idle or philosophical question. Each option has its advantages and, of course, weaknesses.

Advantages of an individual entrepreneur compared to an LLC:

Disadvantages of individual entrepreneurs for catering

  • You cannot get a license to sell strong alcohol, but it is necessary even if you add cognac to your coffee. Without a license you can only sell beer

  1. The authorized capital in the regions must be at least 10,000, but in Moscow - at least 1 million rubles

  3. Location no closer than 100 meters from sports, educational and medical institutions
  4. Availability of all communications: water, sewerage, electricity, heating

  • lease contract
  • an agreement for the installation of a fire alarm, as well as its maintenance by an organization that has the appropriate authority, or an inspection report

  • Purchase and register an online cash register (this can be done at the bank where you opened your current account). To sell alcohol, it must support the EGAIS system

OKVED-2 codes depending on catering activities

Code 56.10 is suitable for restaurants and their food delivery services, but it is also suitable for other organizations that operate permanently or temporarily. This category does not include:

  2. Sales of products that are not self-made products and are not intended for consumption on site.

Documentation

Before dealing with organizational issues, the company must be registered with the tax office. In the case of a coffee shop, you should choose one of 2 forms of organizational and legal ownership: LLC or individual entrepreneur. As the main code according to OKVED, you need to indicate 55.30 “Activities of restaurants and cafes.”

Immediately after receiving documents from the tax office, it makes sense to submit an application to change the tax regime. If it is not possible to apply UTII due to the local specifics of this tax form, preference should be given to the simplified tax system of 15% (income minus expenses), because The costs in a coffee shop are quite significant.

The OKVED qualification directory is an all-Russian standardizer used to identify the types of activities of business entities.
