A license to transport passengers is a document that is issued to both individuals and legal entities. It gives the right to use buses and other vehicles with more than 8 seats in their activities. The corresponding document is necessary for large and small companies. Paper will be needed for domestic and international shipments. The presence of a license confirms the following aspects:

  • The company is able to ensure the safety of passengers;
  • The carrier does not violate the law;
  • The organization employs employees with sufficient experience and qualifications.

If the number of seats for passengers in a vehicle is less than 8, a corresponding permit is not required. Car rental organizations deserve special attention. A permit will be required if the vehicle is provided with a driver. When only a car is transferred to a citizen, there is no need to license the activity.

Who issues

You can obtain a license to operate passenger flights from the following authorities:

  1. The Federal Service for Supervision of Transport issues permission to transport passengers and luggage. This function is assigned to the territorial offices of Rostransnadzor - the department of Gosavtonadzor of a specific subject (clause 2 of Regulation No. 280 “On licensing of passenger transportation by road” dated 04/02/2012, hereinafter referred to as the Regulation; clause 10 of the Administrative Regulations of the Federal Service for Supervision in the Sphere of Transport, approved Order No. 144 of April 29, 2013, hereinafter referred to as the Regulations).
  2. Licenses for international transportation are issued by Gosavtonadzor. He also monitors the compliance of applicant organizations with established requirements during the period when the permit is valid. Eligibility criteria can be found in the Regulations.

You can find your branch in Appendix No. 1 to the Regulations and on the official portal www.rostransnadzor.ru. Individual entrepreneurs apply to the branch at their place of residence, and legal entities - at their location.

License for bus transportation of passengers: package of documents

If you plan to obtain a license for passenger transportation, the documents must be provided by the company itself and the drivers who will be involved during the procedure.

The organization must include the following documentation in the list:

  • Certificate confirming completion of the state registration procedure;
  • Application with a request for a permit to transport passengers;
  • Papers demonstrating compliance with tax registration requirements;
  • Documents for premises and vehicles that will be used to transport passengers;
  • Notarized copies of constituent documents.

The list of papers required from drivers is much smaller. If a person intends to drive a vehicle and transport passengers, he must present a work book with records confirming the presence of the required length of service. Additionally, you will have to undergo a medical examination and receive a conclusion confirming the absence of contraindications to driving a car.

From February 10, 2020, you can only get a permit for a white car. In this case, the body must have a yellow reflective strip with a width of 15 to 25 centimeters. The yellow stripe must be placed along the entire length of the side surfaces at least 10 centimeters from the lower borders of the side window frames. The car must have dark gray stripes with a width of 15 to 25 centimeters, located from the lower border of the body along the entire length of the side surfaces of the body, front and rear bumpers.

In the Moscow region, an application for a permit can be submitted on the portal of state and municipal services of the Moscow region, as well as at the MFC.

If you decide to submit documents for the service online, you can obtain the permit itself at the MFC. The permit is issued for a period of five years.

If an entrepreneur has several cars with which he wants to carry out activities for transporting passengers, he will need to obtain a permit for each vehicle, and he only needs to submit the application once for several cars at once.

To obtain a taxi license, you will need the following documents:

  • application for a permit (can be completed online on the government services portal, or filled out directly at the MFC);
  • applicant's passport;
  • a document confirming the authority of the representative (if the documents are submitted by the applicant’s representative), the representative’s passport;
  • vehicle registration certificate (all copies must be certified by the applicant - the seal of an individual entrepreneur, a personal signature and the inscription “Copy is correct”, the date of certification must also be indicated);
  • a copy of the leasing agreement (if any), which must be certified by the applicant;
  • notarized power of attorney for the right to dispose of a vehicle;

  • a copy of the rental agreement for a vehicle that is supposed to be used to provide services for the transportation of passengers and luggage by taxi.

Where can I get a license to transport passengers by bus?

Rostransnadzor is responsible for issuing licenses for transporting passengers of more than 8 people. If we are talking about regions, the corresponding function is assigned to the departments of the State Traffic Safety Inspectorate. Review of the application takes about one and a half months. The license is granted for 5 years. If the expiration date is approaching, you will need to complete the renewal process. We advise you to start doing this at least a month before the permit expires. The permit for the carriage of passengers can be extended for the same period for which it was originally issued.

License for passenger transportation of more than 8 people for individual entrepreneurs

A license is an official permission for legal entities and individuals to carry out passenger transportation. There are domestic and international transportations; each type of activity requires its own document.

Enterprises specializing in commercial passenger transportation cannot do without this document to make a profit.

Necessity

A license is a confirmation that the carrier meets all the requirements imposed by law on enterprises providing passenger transportation services:

  • guarantees the safety of its passengers;
  • provides services that comply with established norms and standards;
  • The company's drivers have the necessary experience in driving a bus.

A license to operate passenger flights is the only document confirming the professional level of the services offered.

A separate license is not required to transport children (passenger flights are carried out on the basis of a standard permit).

Who needs to buy

You need to obtain a license:

  • organizations that transport passengers around the country, with the number of passengers not exceeding eight people. The bus can be owned by an organization or entrepreneur, or rented;
  • If a company rents out a bus, then a permit for a bus on order will only be required if driver services are provided along with the car. If the car is rented separately, then you do not need to receive a document.

The license is issued for 5 years, then it must be renewed.

No need to fill out:

  • if the company transports passengers by bus for its own needs, for example, delivers employees to their place of work;
  • if there are less than 8 passengers.

What requirements must be met to obtain a license to transport passengers by bus?

Specialists involved in issuing licenses for passenger transportation pay special attention to drivers and vehicles. In order for a company to be granted a license, the following requirements must be met:

  • Drivers involved in transportation have received category D licenses and have a driving experience of at least three years;
  • Persons who will drive a vehicle must obtain a certificate of authorization to drive a vehicle;
  • A medical specialist must always be present at the enterprise to perform a pre-trip examination of drivers;
  • All vehicles must have a tachograph installed;
  • It is permissible to use only technically sound vehicles;
  • A suitable type of vehicle is selected for transportation.

Taxi requirements

16. In order to ensure the safety of passenger taxi passengers and identify passenger taxis in relation to other vehicles:

3) a legal entity or individual entrepreneur engaged in the provision of services for the transportation of passengers and luggage by passenger taxis is obliged to: a) provide maintenance and repair of passenger taxis; b) carry out monitoring of the technical condition of passenger taxis before leaving the line; c) ensure that taxi drivers undergo a pre-trip medical examination.

Requirements for equipping a taxi car:

  • "Checkers" on the body.
  • Car color. Regions can set a specific color that taxi cars must be painted.
  • Taxi lantern on the roof.
  • Taximeter (if the fare for the trip depends on the distance or time of use of the taxi).

Driver requirements:

  • Driving experience of at least 3 years.

Requirements for a legal entity or individual entrepreneur:

  • Providing vehicle maintenance and repair.
  • Checking the technical condition before leaving the line (mechanic’s mark on the waybill).
  • Carrying out pre-trip medical examinations (doctor’s note on the waybill).

Responsibility for carrying out passenger transportation without a license

It does not matter who receives a license to transport passengers - a legal entity, individual entrepreneurs or private individuals. In any case, before issuing a document, the Federal Service Administration is obliged to check the entire organization for compliance with all requirements. If a license is obtained, the recipient must:

  1. Provide documents confirming the right to engage in transportation. The Department may carry out a scheduled inspection of such an organization once every two years. If any violations and inconsistencies are identified, then unscheduled inspections can be expected in the future.
  2. The carrier must comply with established transportation rules. Both the State Traffic Inspectorate and the customs authorities have the right to control this if the transportation has an international level.

But what to do if there is no license, and the organization is engaged in transportation? What fines are expected? First of all, you need to know who will bear responsibility for the lack of a license? It is clear that if an ordinary private person is engaged in such activities, then he will be punished in the form of a fine. If the case involves a larger company, who is liable for the fine? The fine is issued to those persons who gave their consent and allowed passenger transportation to take place, or to the organization itself. If, after a fine has been issued, the activity of transporting passengers continues to be carried out, then during a second inspection you may be left without a vehicle; it will simply be confiscated.

If the controlling organization detects the absence of a license, the driver has the right to:

  • give his consent that the transportation was indeed carried out with an offense, ultimately signs the protocol and receives a fine;
  • try to defend your case by proving that he transports passengers outside the framework of the law, that is, for example, he transports friends without charging them for travel.

But the result may be that you will have to appear in court, where you will have to defend your rights.
In this case, you will need to prove your case by presenting evidence in the form of testimony from those passengers who were transported, documents for ordering tourist services, a waybill issued by the company for the driver, which indicates the purpose of the trip. The Code of Administrative Violations states that a fine will be imposed for carrying out passenger transportation without a license. What could be the amount of the fine?

  1. A private person who violates the law is subject to a fine of 50,000 rubles. The same applies to officials.
  2. For individual entrepreneurs the amount is 100,000 rubles.
  3. The largest fine awaits organizations that are legal entities. Here the amount is 400,000 rubles.

If the violation has not been eliminated, then if the nonconformity is detected again:

  1. The vehicle used for transportation may be confiscated.
  2. The carrier company is suspended or suspended for 90 days.

Whatever the type of passenger transportation, the fines for all types are the same.

In addition, additional fines may apply regarding the transportation of passengers by passenger transport (taxi). For example, taxis do not have signs with operating rules and tariffs. The taxi has not equipped a system that will issue receipts for the provision of services.

Refusal of application

Sometimes Rostransnadzor refuses to issue a license. This occurs in the following situations:

  • the documents contain incorrect or erroneous data;
  • the applicant does not meet the requirements for carriers.

Violation of the established rules for transporting passengers may result in administrative liability and cancellation of the license. Transporting passengers without obtaining a license is also punishable.

In order to obtain a license for international passenger transportation by bus, all drivers who will operate flights must have three years of experience on the domestic route. If you have an international license, no additional permission is required for domestic transportation.
