How to apply for employment as an individual entrepreneur?

Registration of employment in an individual entrepreneur does not differ from the procedure provided for enrollment in organizations of various forms of ownership. Citizens have the right to carry out entrepreneurial activities:

  • who have reached the age of 16 when filling out the application and signing it with their own hand;
  • from 15 years for positions not related to the implementation of labor functions in industries with hazardous conditions;
  • from the age of 14 with the written consent of parents or guardianship authorities.

The employee's qualifications must correspond to the position held.

What documents will be needed?

The content of labor relations with entrepreneurs does not differ from those established by law between employees and legal entities.

The list of documents required to apply for a position is regulated by Article 65 of the Labor Code of the Russian Federation, it includes:

  • employment history;
  • TIN certificate;
  • SNILS for calculating insurance premiums;
  • a copy of the diploma or courses confirming completion of professional training courses;
  • ID card of a citizen of the Russian Federation in duplicate;
  • document on military registration;
  • when appointed to a number of positions - a certificate of good conduct from law enforcement agencies.

What is the correct statement?

HR departments usually keep sample applications for quick completion by hand or using technical means and hand them over for signature by the employee. The sample document should consist of:

  • in the upper right corner - full name of the individual entrepreneur, full name of the employee, passport details;
  • in the middle - the name of the document - an application for employment, below is the main text in free form: I ask you to accept the position indicating the full name of the employee;
  • the applicant’s signature and the date the document was drawn up, it is possible to mark the incoming number of the personnel department.

The application is affixed with a resolution on acceptance to the position by the head of the enterprise or the personnel officer.

The foreign citizen must fill out and sign the document in Russian in the same manner. If he does not speak Russian, then his appointment to a position with the corresponding job responsibilities is explained by a translator, and the employee signs with his own hand.

The presence of foreign citizenship or its absence does not affect the content of labor relations.

The order of acceptance to work

The order is issued by the personnel department or drawn up by an entrepreneur who is entrusted with such responsibilities by law. The form of the document differs little from those drawn up for organizations. The main conditions are:

  • name of the individual entrepreneur and registration number with the tax service - TIN, entries in the Unified State Register of Individual Entrepreneurs;
  • full name of the employee hired for the position;
  • dates of taking office, drawing up the document;
  • signature of an authorized person to sign the application - a personnel employee or an individual entrepreneur.

The employment agreement is drawn up on the basis of the requirements specified in the Labor Code of the Russian Federation. There are no special requirements for formalizing relations when signing a document with an individual entrepreneur. How to fill out an individual entrepreneur’s work book

A record of appointment to the position must be made in the work book of a newly arrived employee within 5 days after being hired for a position.

If an employee is employed under an employment contract for the first time, then the entrepreneur should draw up a document for him based on the requirements of labor law. In this case, a title page is filled out indicating the full name, date of birth and education, the blue seal of the individual entrepreneur is affixed and the signature of the person responsible for maintaining personnel records.

If typos and errors in the application and employment order do not have legal significance, due to which the document cannot be declared invalid, then the preparation of the work book must be carefully considered. Corrections are recorded, the seal of the employing company and the signature of the individual entrepreneur or personnel employee are affixed.

Instructions for completing an application for employment

The standard for a job application according to the rules of office work does not have any special features.

  • management position (general director, director, production manager, etc.),
  • full name of the enterprise (including its legal form),
  • last name, first name, patronymic of the manager (the first and patronymic names can be given as initials).

Next, enter the last name, first name and patronymic of the person applying for a particular position.

A little lower, in the middle of the sheet, you should write the name of the document, in this case it will be the word “application” with a capital (small) letter and put a period.

Then they write what the document is actually created for: a request for employment. Here we indicate:

  • job title,
  • the date (day, month, year) from which the future employee wants to begin his official duties,
  • the structural unit (department) to which the vacancy belongs, provided that the employee will not work in the main office,
  • nature of work (main or part-time, seasonal, temporary, etc.),
  • salary amount,
  • probationary period (from 1 to 3 months - this must be discussed in advance with the employer’s representative).

It should be remembered that such a receipt automatically shifts responsibility for everything that happens during the work process from the employer to the employee.

In some cases, HR specialists ask to add a note to the usual text of the application stating that the future employee was informed about his rights and responsibilities in the workplace, and was also instructed in safety and fire safety and was familiarized with the collective agreement and internal labor regulations.

Personnel nuances

The following points are also characteristic for registering a citizen to work in an individual entrepreneur:

  1. According to the law, entrepreneurs are not required to maintain personnel records. They have the right to deal with this issue independently to optimize accounting and tax accounting. Application procedure

The application is submitted to the HR department along with a package of accompanying documents in accordance with Article 65 of the Labor Code of the Russian Federation.

Documents required for submission to the HR department:

  • passport (original and copy);
  • TIN (original and copy);
  • education document;
  • work book (if any);
  • military ID (original and copy);
  • marriage registration certificate.

Important! As for hiring the general director, he does not write an application. This procedure is regulated by Chapter 43 of the Labor Code of the Russian Federation.

The legislation provides for the right of employers to demand the presentation of other documents not included in this list. This may be a certificate of a completed medical examination, a work permit if the person applying for a job is a foreign national, etc.

After a candidate for a vacant position is approved, an order for his employment is issued. The number and date of adoption of this order are written by the head of the personnel department under the text of the application.

Registration with a budget organization

With regard to signing an application for employment in municipal and state authorities, special laws apply.

It is not necessary to write an employment application when concluding an agreement with an individual entrepreneur, except for the cases listed in the regulations:

  • Federal Law No. 79 of April 27, 2004 upon enrollment in the civil service, on the basis of clause 2 of Article 16;
  • Federal Law No. 25 of 03/02/2007 when applying for a position in municipal authorities, in accordance with paragraph 3 of Article 16 of this law.

In other situations not listed in these provisions, the employee retains the right to sign an application for employment, but such an obligation does not arise. Such rules continue to apply under labor law in 2020.

Part-time reception

A person can get a job with an individual entrepreneur and enter into an employment contract with him not on a full-time basis, but part-time. When signing an employment agreement, it is important to pay attention to working hours standards. A person can work no more than 4 hours a day if he gets a part-time job.

Please note! An employee can work 8 hours a day only if he is not employed anywhere else.

How to write a job application

In the application, you address the head of the organization with a request to hire you.

Let's figure out exactly what data and information needs to be indicated in the application:

  1. The header of the document indicates the position of the immediate supervisor and the name of the organization in the appropriate (dative) case. If you know the full name of the employer, it would be useful to indicate them as well. Check the correct spelling of the organization name. Pay attention to abbreviations and quotation marks. You must know the correct name of the organization you want to become an employee of, otherwise an awkward and awkward situation may arise that could affect your career in this company.
  2. Next, you indicate your information - from whom the application is being submitted. Please disclose your full name, without abbreviations, again in the appropriate (genitive) case.
  3. The registration address must match the passport data. Be careful.
  4. The name of the document you are submitting is “Application”. Write this word without any punctuation marks.
  5. The text of the application must contain a request to enroll you from a certain date to a specific position with the name of the structural unit - department, workshop, etc.

For example:

Be sure to indicate the date of writing and submitting the application, certify the document with your signature and its transcript (here it is enough to write down your last name and initials).

Note: adhere to the same style of document design. If the text is handwritten, fill it all with one paste. If you print on a computer, format the finished text to fit one type of font.
